Short answerA special needs (supplemental needs) trust lets parents, grandparents or others leave funds for a person with a disability in a way that supplements — rather than replaces — needs-based government benefits such as SSI and Medi-Cal. Leaving money outright can cause benefits to be lost.

Families with a special needs family member must plan carefully for who will care for that person when they are no longer able to, and where the money for that care will come from. We help families develop a plan that addresses the social, financial and legal aspects of the individual’s future.

Planning elements

  • Third-party special needs trust within your living trust or as a stand-alone trust
  • Choosing a trustee who understands benefit rules
  • Coordinating beneficiary designations so funds don’t go directly to your loved one
  • Guardianship or conservatorship considerations as your child approaches 18

Common questions

Can relatives leave money directly to my child with a disability?

They can, but it may affect needs-based benefits. Ask family members to leave gifts to the special needs trust instead.
